Peggy is an experienced Arbitrator who has served in well over 500 arbitrations for commercial, employment, and personal injury matters. Peggy is a panelist for the American Arbitration Association’s (AAA) Employment, Commercial and Judicial panels. She is also an Arbitrator for Financial Industry Regulatory Authority (FINRA) and Resolute Systems, Inc.

As a former Judge, Peggy has a unique perspective on litigation. She is decisive and experienced in moving disputes expeditiously through the arbitration process, while controlling costs for the parties. Her proven judicial experience in state court provides her with the legal knowledge required to serve as an Arbitrator in a variety of practice areas and case types.

Employment

wrongful termination, harassment, discrimination (race, disability, sexual orientation, gender, religious beliefs and age), retaliation, hostile work environment, wage disputes, FLSA matters, class actions, severance agreements, EEOC complaints, breaches of non-compete and non-solicitation provisions.

Products liability

defective manufacture and design, failure to provide warnings.

Insurance

general commercial liability, professional E&O claims, fraud and bad faith, D&O liability disputes, business interruption and property loss, product liability claims and construction defects.

What is Arbitration?

Arbitration is a private process where Parties involved in a dispute agree to have a neutral third person, an Arbitrator, or a panel of Arbitrators, render a binding decision about the dispute. After the Arbitrator is chosen, the Parties set a schedule to exchange information and documents that are relevant to the case. After discovery is completed, a hearing is held before the Arbitrator where the Parties present witnesses and evidence and make arguments about their position.

Arbitration is different than mediation in that the Arbitrator has the authority to make a binding decision and the decision is enforceable in the courts. By agreeing to Arbitration, the Parties are giving up their right to a trial by jury and the decision is not appealable, except in limited circumstances. Cases can be referred to arbitration by a judge or the case can be submitted to Arbitration by agreement of the Parties.

What are the benefits of Arbitration?

Resolving cases through arbitration is usually far less expensive than litigating the case in court because the process is quicker and generally less complicated than a court proceeding. The rules of evidence and court procedures do not apply in arbitration proceedings. Rather, the Parties can agree to the rules and procedures that will apply to their dispute. The Parties often choose an agency to administer the dispute, such as the American Arbitration Association and then that agency’s rules will govern the procedures that will be followed.

Arbitration is also more flexible as the hearings can be scheduled around the availability of the Parties and their counsel.
